our services or digital products;
business practices;
technology;
legal or regulatory requirements; or
security and risk-management practices.
The current version will be published on the website with its last-updated date.
Changes apply from the date the updated Terms are published. Changes will not retrospectively alter rights or obligations already accrued, except where required or permitted by law.

use the website for any unlawful, fraudulent or misleading purpose;
provide false, inaccurate or unauthorised information;
impersonate another person or organisation;
interfere with the website’s operation, security or availability;
attempt to gain unauthorised access to the website, server, accounts or systems;
introduce viruses, malicious code or harmful technology;
test or probe website security without written authorisation;
bypass access controls, payment requirements or download restrictions;
use automated systems to scrape or systematically extract website content;
harvest names, email addresses or other information;
use website content to train or develop a competing commercial product without written permission;

use the website in a way that damages ECSEC’s reputation or rights;
misrepresent your relationship with ECSEC; or
assist another person to engage in prohibited conduct.
8. No professional engineering engagement
Accessing the website does not establish a professional relationship between you and ECSEC.
The following activities do not, by themselves, appoint ECSEC as a structural engineer or create an engineer-client relationship:
visiting the website;
reading technical material;
submitting an enquiry;
requesting a quotation;
sending project documents;
having a preliminary discussion;
purchasing a digital product; or
receiving general information from ECSEC.
A professional engagement begins only when ECSEC and the client agree to a written proposal, engagement agreement, contract or other written appointment defining the applicable scope and terms.
Until a written engagement is confirmed, you should not rely on ECSEC as having accepted responsibility for a project, deadline, design or deliverable.
9. General information only
Website content is general information and does not constitute:
project-specific engineering advice;
structural design;
structural certification;
a design declaration;
construction instructions;
approval of a structure or structural system;
independent design verification;
legal, financial, insurance or regulatory advice; or
confirmation that a project complies with applicable legislation, codes or standards.
Structural-engineering decisions depend on project-specific factors. These may include:
site and geotechnical conditions;
building geometry and intended use;
structural arrangement and load paths;
imposed, environmental and construction loads;
materials and workmanship;
durability and exposure conditions;
fire requirements;
construction sequence and temporary conditions;
architectural and services coordination;
applicable legislation;
building classification;
jurisdiction; and
current editions of relevant codes and standards.
You should obtain appropriately qualified professional advice before relying on technical information for a project.
10. Project information and previous experience
The website may present:
projects delivered directly by ECSEC;
current ECSEC commissions;
conceptual or illustrative technical material; and
professional experience gained by ECSEC’s Director while employed by previous engineering consultancies.
Where project experience was gained during previous employment, ECSEC does not claim to have been the appointed consultant unless expressly stated.
You must not interpret the inclusion of prior professional experience as a representation that ECSEC:
contracted directly with the project client;
owned the previous employer’s work;
prepared all project documentation;
had responsibility for the entire project; or
remains responsible for the completed project.
11. Intellectual property
Unless otherwise identified, ECSEC owns or is authorised to use the intellectual property appearing on or supplied through the website, including:
the ECSEC name, logo and branding;
website text and layouts;
graphics, photographs and illustrations;
technical articles;
calculation templates;
engineering spreadsheets;
standard details;
design workflows;
technical publications;
downloadable resources;
product descriptions;
software logic and formulas; and
compilation and arrangement of website content.
The website and its content are protected by applicable intellectual-property laws.
Your access to the website does not transfer ownership of any intellectual property to you.
12. Limited permission to use website content
You may:
view publicly accessible website pages;
print or save reasonable extracts for personal reference;
share a link to a publicly accessible ECSEC page; and
use purchased digital products according to their applicable licence.
Unless ECSEC gives written permission, you must not:
reproduce substantial website content;
republish content on another website or platform;
modify or create derivative commercial material;
sell or sublicense website content;
remove ownership, copyright or attribution notices;
use ECSEC’s name or logo to suggest endorsement;
distribute purchased products to other users;
incorporate ECSEC content into another commercial product; or
present ECSEC material as your own work.
13. Third-party intellectual property
The website may refer to third-party:
engineering textbooks;
authors;
publishers;
Australian Standards;
legislation;
software;
technical methods;
products; or
trademarks.
Ownership of third-party material remains with the relevant owner.
A reference to a third-party publication, author, standard or product does not, by itself, mean that the third party:
sponsors ECSEC;
endorses ECSEC;
approved an ECSEC digital product; or
is commercially associated with ECSEC.
ECSEC products must not be represented as official supplements to, or authorised reproductions of, third-party publications unless ECSEC has obtained and states the relevant authorisation.
14. Digital products
ECSEC may offer downloadable products, including:
engineering spreadsheets;
calculation tools;
templates;
worked-example tools;
technical resources; and
bundled engineering materials.
Digital products are licensed, not sold outright. Purchasing a product does not transfer copyright, ownership or underlying intellectual property.
Use of each product is subject to:
these Terms;
the Digital Product Licence;
the Refund Policy;
its product description;
product-specific limitations and instructions; and
applicable law.
If these Terms conflict with a product-specific licence, the product-specific licence applies to the extent of the conflict in relation to that product.
15. Digital products as calculation aids
Digital engineering products supplied through the website are calculation aids and educational or professional-support resources.
They do not constitute:
project-specific engineering advice;
structural certification;
design approval;
independent verification;
a guarantee of compliance; or
a substitute for competent engineering judgement.
The user is responsible for:
confirming that they are appropriately qualified to use the product;
verifying all inputs;
checking formulas, outputs and units;
confirming assumptions and limitations;
independently verifying calculations;
selecting the appropriate design criteria;
checking the complete structural system and load path;
applying the correct legislation, codes and standards;
confirming the current and applicable standard edition;
ensuring compatibility with the user’s software; and
determining whether the output is suitable for the relevant project and jurisdiction.
16. Product descriptions and compatibility
ECSEC will endeavour to describe digital products accurately, including relevant information about:
product content;
software or file format;
design-standard edition;
product version;
intended use;
licence scope; and
known limitations.
Before purchasing, you are responsible for reviewing the product description and confirming that:
the product is suitable for your intended purpose;
you have compatible software and hardware;
you possess the required technical knowledge; and
any referenced standard or methodology is appropriate for your work.
Images, screenshots and sample outputs may be illustrative and may differ from the downloaded product depending on the product version, software version, display settings or authorised updates.
17. Prices and GST
Unless otherwise stated:
prices are displayed in Australian dollars;
applicable GST will be included or identified during purchase;
prices may change before an order is completed; and
the price applying to an accepted order is the price displayed at checkout, subject to correction of obvious errors and applicable law.
A price displayed on the website does not create an obligation to supply where there has been an obvious technical, typographical or pricing error.
If an error affects an order, ECSEC will contact the purchaser and provide an appropriate option consistent with applicable law.
18. Orders
An order is an offer by you to purchase a product under these Terms and any applicable product terms.
ECSEC may accept an order by:
issuing an order confirmation;
processing payment;
providing a download link;
granting account access; or
otherwise supplying the product.
ECSEC may refuse or cancel an order where reasonably necessary because of:
suspected fraud;
unauthorised payment;
pricing or technical error;
product unavailability;
website misuse;
licence restrictions; or
legal or regulatory requirements.
If ECSEC cancels an order after receiving cleared payment and no lawful basis exists for retaining the payment, ECSEC will arrange an appropriate refund.
19. Payments and transaction processing
Payments may be handled by third-party payment providers.
You must:
provide accurate transaction information;
use a payment method you are authorised to use;
pay all applicable charges shown before confirming the purchase; and
comply with the payment provider’s applicable terms.
ECSEC is not responsible for delays caused solely by payment-provider processing, banking systems or incorrect information supplied by the purchaser.
Nothing in this section limits any responsibility ECSEC has under applicable law.
20. Download delivery
Digital products may be supplied through:
an on-screen download;
an emailed download link;
a customer account;
a third-party delivery platform; or
another electronic method identified at checkout.
You are responsible for:
providing a correct email address;
checking spam or junk folders;
protecting download links and account credentials; and
downloading the product within any clearly disclosed access period.
If you experience a genuine access or download problem, contact info@ecsec.com.au with your order details.
21. Accounts and credentials
If the website allows account creation, you must:
provide accurate information;
maintain the confidentiality of your password;
restrict access to your account;
notify ECSEC promptly of suspected unauthorised access; and
accept responsibility for activity conducted through your account to the extent permitted by law.
You must not share an account or use another person’s account without authorisation.
ECSEC may suspend account access where reasonably necessary to investigate a security incident, licence breach, fraudulent activity or material breach of these Terms.
22. Refunds and consumer guarantees
Purchases are subject to ECSEC’s Refund Policy and the Australian Consumer Law where applicable.
Australian consumer guarantees apply automatically to qualifying goods and services and cannot be removed by contractual terms or business policies.
Nothing in these Terms excludes, restricts or modifies:
a consumer guarantee;
a statutory right;
a statutory remedy; or
another right or liability
that cannot lawfully be excluded, restricted or modified.
Change-of-mind refunds for downloaded digital products may not be available unless ECSEC expressly offers them. This does not affect any remedy available under the Australian Consumer Law.
23. Professional services
Information about professional services on the website is general and does not replace a project-specific proposal.
Professional structural-engineering services are governed by the applicable written engagement, which may address:
scope;
exclusions;
deliverables;
programme;
fees and payment;
client responsibilities;
variations;
intellectual property;
reliance;
insurance;
liability;
dispute resolution; and
termination.
ECSEC’s business planning provides for professional services to be priced using fixed fees, hourly rates or staged fees depending on scope certainty and risk, with variations and out-of-scope services requiring written approval.
If these Website Terms conflict with an executed professional-services agreement, the executed agreement prevails for that professional engagement.
24. Enquiries and submitted information
When you submit an enquiry or provide project documents, you represent that:
you are authorised to provide the information;
the information is not knowingly false or misleading;
its provision does not infringe another person’s rights; and
ECSEC may review it for the purpose of responding to your enquiry.
Do not send highly confidential, security-sensitive or privileged information through an unsecured website form unless suitable arrangements have first been agreed.
Submitting information does not oblige ECSEC to accept an engagement.
25. Privacy
ECSEC handles personal information in accordance with its Privacy Policy and applicable privacy law.
By using the website or submitting information, you acknowledge that personal information may be handled as described in the Privacy Policy.
The Privacy Policy should be read together with these Terms but does not form part of a contract to the extent that applicable law provides otherwise.
26. Third-party websites and services
The website may contain links to, integrations with or references to third-party websites and services.
ECSEC does not control third parties and is not responsible for their:
content;
availability;
security;
accuracy;
privacy practices;
contractual terms; or
products and services.
A link or reference does not necessarily constitute endorsement.
You access third-party websites and services at your own discretion and should review their applicable terms and privacy policies.
27. Website availability
ECSEC aims to maintain website availability but does not guarantee uninterrupted, secure or error-free access.
The website may be unavailable because of:
maintenance;
software updates;
technical faults;
telecommunications failure;
service-provider interruption;
cybersecurity incidents;
events outside ECSEC’s reasonable control; or
changes to website functions.
ECSEC may modify, suspend or discontinue any part of the website were reasonably necessary.
28. Accuracy and currency
ECSEC takes reasonable care in preparing website content but does not warrant that all material will always be:
complete;
error-free;
current;
suitable for a particular project; or
available without interruption.
Engineering standards, legislation, technical guidance, software and professional practices may change.
A publication date or product version does not eliminate the user’s responsibility to confirm that information remains current and appropriate.
29. Security
You acknowledge that internet communications and electronic systems carry security risks.
Although ECSEC takes reasonable measures to protect its website and information, ECSEC cannot guarantee that:
the website will be free of malicious code;
transmissions will be completely secure;
unauthorised access will never occur; or
downloaded files will operate in every technology environment.
You should use current security software and maintain appropriate backups before opening or using downloaded files.
30. Disclaimer of implied terms
To the extent permitted by law, ECSEC excludes warranties, representations and conditions not expressly stated in these Terms.
This exclusion does not apply to rights, guarantees or remedies that cannot lawfully be excluded, restricted or modified.
31. Limitation of liability
Nothing in these Terms excludes, restricts or modifies liability were doing so would be unlawful.
Subject to that requirement and to the maximum extent permitted by law, ECSEC is not liable for loss arising solely from:
reliance on general website information without obtaining project-specific advice;
use of technical material outside its stated purpose;
incorrect or incomplete user inputs;
failure to independently verify engineering calculations;
use of an incorrect or superseded design standard;
unauthorised modification of a digital product;
unlawful or unlicensed distribution of a product;
incompatible software or systems not meeting stated requirements;
third-party websites or services;
security incidents outside ECSEC’s reasonable control; or
interruption of website availability outside ECSEC’s reasonable control.
Any limitation must be interpreted subject to the Australian Consumer Law and other applicable legislation.
32. Indemnity
To the extent permitted by law, you indemnify ECSEC against losses, liabilities, damages and reasonable costs directly arising from:
your unlawful use of the website;
your material breach of these Terms;
your infringement of ECSEC’s or another party’s intellectual property;
your unauthorised distribution of a digital product;
information you submit without proper authority; or
fraudulent or deliberately harmful conduct.
This indemnity does not apply to the extent that the loss was caused or contributed to by ECSEC, its officers, employees, contractors or agents.
33. Suspension and termination
ECSEC may suspend or terminate your access where reasonably necessary because:
you materially breach these Terms;
you use the website unlawfully;
you compromise website security;
you infringe intellectual-property or licensing rights;
fraudulent activity is reasonably suspected; or
suspension is required by law.
Where appropriate and reasonably practicable, ECSEC may provide notice and an opportunity to remedy a breach.
Termination does not affect rights or obligations accrued before termination.
Provisions intended to continue after termination, including intellectual-property, liability and governing-law provisions, remain effective.
34. Reporting infringement or misuse
If you believe that:
website content infringes your rights;
an ECSEC digital product is being distributed without authorisation;
someone is impersonating ECSEC;
the website is being misused; or
a security issue exists,
contact info@ecsec.com.au with sufficient information for ECSEC to investigate.
Do not attempt to test or exploit a suspected security vulnerability.

36. Dispute resolution
If a dispute concerns the website or a digital-product purchase, either party should first notify the other in writing and provide reasonable details of the issue.
The parties should attempt to resolve the matter through good-faith discussion before commencing formal proceedings, except where:
urgent court relief is required;
intellectual-property or security misuse must be restrained;
a statutory process applies; or
delaying action may prejudice a legal right.
This section does not prevent a consumer from exercising a right or remedy available under applicable law.
37. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia.
Subject to any mandatory consumer-law or jurisdictional requirements, you and ECSEC submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
38. Severability
If a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary.
If it cannot be read down, it will be severed without affecting the remaining provisions, to the extent permitted by law.
39. No waiver
If ECSEC does not immediately enforce a right under these Terms, that does not mean ECSEC has waived the right.
A waiver is effective only if it is clearly provided in writing by ECSEC.
40. Entire agreement for website use
These Terms, together with policies and conditions expressly incorporated by reference, constitute the agreement governing general use of the website.
They do not replace:
an executed professional-services agreement;
